J. Michael Monahan is an attorney with the Chicago
law firm of Pattishall, McAuliffe, Newbury Hilliard & Geraldson, LLP.
Mr. Monahan practices in the areas of trademarks, copyrights, trade
secrets and other intellectual property, counseling clients on the
establishment, development and protection of intellectual property
assets through registration, policing, enforcement through litigation
and ADR, and the commercial exploitation of these assets through
licensing, franchising, and other transactions.
Mr. Monahan teaches Video Game Law at Chicago-Kent Law School and is a
frequent speaker on the law of video games, massively-multiplayer online
games and social networking issues. His presentations include:
"Can My Game be a Brand?" -- GDC Canada 2008 in Vancouver;
"My Game, My Rules: the Power and Pitfalls of End User License
Agreements in Games." 2008 Austin Game Developers Conference, Austin
Texas (September 15, 2008);
"License Agreements: Best Practices, Avoiding Pitfalls" at the 2008
Virtual Worlds/Virtual Law Conference in April 2008.
He also has spoken on numerous intellectual property topics, including
nominative fair use of trademarks, intellectual property rights and
licenses in bankruptcy, and intellectual property law for the general
practitioner.
Mr. Monahan authored "Using IP Rights is Not a Game" for the December
2006/January 2007 issue of Managing Intellectual Property magazine. Mr.
Monahan is the co-author of Chapter 4 (Criminal Enforcement of State
Anticounterfeiting Laws), Trademark Counterfeiting, Aspen Law &
Business, 2001 and 2002 Supplements; the co-author of Louisiana Limited
Liability Companies: Forms and Practice Manual, 2nd Ed., Data Trace
Publishing Company, (2001); and the author of "Waiting By the Phone: Why
Telephone Number Mnemonics Warrant Trademark Protection," a comment
published in the Louisiana Law Review at 58 La. Law Rev. 281.
Mr. Monahan is also a member of the American Bar Association, the
American Intellectual Property Law Association, the Illinois State Bar
Association, the Louisiana State Bar Association, the Chicago Bar
Association and the New Orleans Bar Association.
